A tribe located within Idaho is challenging the state’s anti-poker position.

According to the Associated Press, the Coeur d’Alene Tribe plans to offer live poker after deciding Idaho’s constitutional ban on the game doesn’t apply to its casino. The facility already has slot machines and bingo.

The tribe will open its poker room on May 2, despite Idaho saying it’s not allowed.

Helo Hancock, the tribe’s legislative director, reportedly believes that the state cannot tell the tribe ‘no’ thanks to the federal Indian Gaming Regulatory Act.

An Idaho official said that since poker is banned statewide, it wouldn’t be exempt from state regulation under the federal law.

So, there’s clearly a major difference in interpretation between the two parties.

As a result, Idaho has asked the feds to help in the matter

“We’re aware of the tribe’s intention to offer poker, and we’re working through our own analysis of the matter right now,” a person with the Indian gaming commission said.

That hasn’t stopped the tribe from moving toward opening, which includes hiring dealers.
