Arkansas Supreme Court Deals Fatal Blow To Casino Vote

Votes On Issue 5 Ordered Not To Be Counted

A question on the Nov. 8 ballot to allow three casinos in Arkansas has been struck down by the state Supreme Court because it contains language about legalizing sports betting.

The high court issued a ruling Thursday

The court agreed with opponents that pointed out that Arkansas can’t legally offer sports betting because of the Professional and Amateur Sports Protection Act of 1992. The federal law limited sports betting to just a few states.

Though the casino industry is trying to get the law overturned, it’s still the law of the land.

“It is not required that the ballot title contain a synopsis of the proposed amendment, but it should be complete enough to convey an intelligible idea of the scope and import of the proposal,” the court wrote.

The ruling means that officials have been ordered not count any votes cast for the measure.

In September, supporters of the plan were able to turn in more than 100,000 valid signatures to get the proposal on the ballot.

The Arkansas Supreme Court made a similar ruling on a casino measure in 2012.
