The Court of Appeal in London yesterday ruled that poker is largely a game of luck. It upheld the decision of Snaresbrook Crown Court last year to find Derek Kelly, former chairman of London’s Gutshot Club, guilty of breaching the 1968 Gaming Act.
Kelly contended that poker was a game of skill, and, as such, he did not need a license to operate and charge for hosting games. He was conditionally discharged for two years.
