New York Judge Won't Help DFS Sites Stay OpenDraftKings, FanDuel Case To Have Hearing Next Week |

For now a New York judge won’t offer much help to the daily fantasy sports industry that was recently told by the state’s top attorney that the business isn’t welcome.
DraftKings and FanDuel, the two leading DFS sites, asked the state Supreme Court in Manhattan for an injunction and an immediate restraining order to allow them to keep doing business in the Empire State while the case plays out, according to a report from the Associated Press. The requests have so far been denied.
Both businesses have sued New York after the state warned them about continuing to offer contests to state residents. FanDuel is based in New York.
Last week, New York’s attorney general sent cease-and-desist letters to the companies, saying that their products violated anti-gambling laws in the state.
The Empire State, which has 19.75 million residents, represents nearly 13 percent of the active users for the two companies, according to company filings. That’s roughly 1.1 million accounts.
The state argued in court this week that it hasn’t actually done anything to implement a ban and prevent the sites from doing business in New York. The cease-and-desist letters reportedly have already greatly impacted processing deposits for New Yorkers.
The companies will be back in court on Nov. 25.
